Establishment Resolution

Resolution Decision of the Presidential Council of the Government of National Accord No. 412 of 2018 AD regarding the establishment of the Medical Training Deanship Center,

The Presidential Council,

  •  after reviewing the constitutional declaration and amending it.
  •  And on the Libyan political agreement, the position on 12-17 AD.
  •  And the State Financial System Law and the Budget and Stores Regulations, as amended.
  •  And Law No. 106 of 1973 AD regarding the issuance of the Health Law and its implementing regulations.
  •  And Law No. 17 of 1986 AD, regarding medical liability.
  •  And Law No. 12 of 2010 AD, Concerning Labor Relations, and its implementing regulations.
  •  And Presidential Council Resolution No. 04 of 2016 AD, regarding the formation of the reconciliation government.
  • And Presidential Council Resolution No. 12 of 2016 AD, regarding delegation of tasks.
  • Building the letter of the Director of the National Center for the Development of the Health System No. 201 dated 3/18/2018 AD, regarding the requirements of the public interest.

Decided

Article 1 AUTONOMY and subordination

Under provisions of this resolution” Council called” medical training baptisms Council has established independent legal personality financial disclosure, and followed the Ministry of Health.

Article 2 Headquarters

The headquarters of the Council shall be in the city of Tripoli.

Article 3 Supervision

Training deanships shall be established to supervise higher medical training in the regions of Libya, the number and distribution of which shall be determined by a decision of the Council of Ministers based on a proposal from the Minister of Health.

 Article 4 Goals

The council aims to qualify and train doctors in accordance with modern scientific systems through:

  1. Preparing higher training programs for doctors in accordance with national standards that are carried out by the General Health Council on the morning of the Council of Medical Specializations in cooperation with the specialized societies.
  2. Practical training for doctors in accredited training centres.
  3.  Preparing and implementing regulations for following up the professional competence of physicians involved in the training program and ensuring their compliance with the stages and steps of the programs stipulated in the regulations after they are approved by the Medical Specialties Council and the General Health Council.
  4. Integrated for doctors trained in the higher training program in order to qualify them to sit for the examination for the specialist certificate granted by the Council of Medical Specialties according to the controls and standards agreed upon between the Council of Medical Specialties and the General Health Council.
  5.  The Council is responsible for paying the remuneration of the doctors who were in contact with the training program and supervising their work and the morals of their party upon the end of the training program.

 Article 5 Administration

The board is managed by a board of directors named by a decision of the Council of Ministers based on a proposal from the Minister of Health, and the board consists of: The

  1. Chairman of the board.
  2. Deans of training in the regions.
  3. A representative of the Ministry of Education.
  4. A representative of the Ministry of Health.
  5.  Chairman of the Council of Specialties.
  6.  Chairman of the Public Health Council.

 Article 6 Tasks

The council chairman shall undertake the following tasks:

  1.  Represent the council in its relationship with others and before the judiciary.
  2. Financial and administrative supervision of the council and its employees and workers.
  3.  Issuing the necessary decisions to implement the council’s tasks and achieve its goals.
  4.  Supervising the preparation of the annual draft budget for the Council and presenting it to the members for approval and status of the Council of Ministers.
  5. Forming permanent committees for the council’s work and defining their tasks.
  6.  Preparing reports on the Council’s activities and submitting them to the Council of Ministers.
  7.  Signing contracts concluded by the Board.
  8.  Any other tasks related to the Council’s work.

Article 7 District Administration

The council assigns the Deanship of Training to the regions, and they perform their duties on a full-time basis.

Article 8 The organizational

structure The organizational structure of the council, its divisions, its terms of reference, and the determination of the salaries and benefits of the chairman and members of the council and its workers shall be issued by a decision of the Council of Ministers, based on a proposal from the Minister of Health.

Article 9 The

budget is an independent budget that is included in the state’s general budget and is prepared in accordance with the applicable accounting systems. The fiscal year begins with the beginning of the state’s fiscal year and ends with its end, provided that the council’s first fiscal year begins from the date this decision comes into effect.

 Article 10 Account

The Council has a bank account or more open He has one of the commercial banks operating in Libya in accordance with the legislation in force.

 Article 11 Financial Resources

The council’s financial resources consist of:

  1.  What is allocated to it from the state’s general budget sums?
  2.  In return for the services provided by the Council.
  3.  The donations and aid he receives are unconditional.
  4.  Any other resources allowed.

 Article 12 Publicity

This decision shall be enforced from the date of its issuance, and the competent body shall implement it.
